Acceptance of These Terms

By accessing or using our website, applications, forms, recommendation tools, campaign pages, or related services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the services.

These Terms are entered into between you and Cannabox Co., Ltd., the operator of Fairly Good Cannabis and related digital experiences.

Eligibility and Legal Use

You may use our services only if you are legally able to do so under applicable law. For cannabis-related purchase, consultation, dispensing, pickup, or delivery functions, you must also satisfy any additional eligibility requirements that apply under Thai law, branch policy, professional review, and product restrictions.

You must not:

• use our services under a false identity;
• submit false, incomplete, or misleading health, prescription, passport, age, or contact information;
• use another person's account, prescription, or rewards membership without authorization;
• use the site or services for unlawful resale, diversion, or export;
• attempt to obtain cannabis products where doing so would violate law, medical guidance, or our compliance procedures.

Informational Content and No Medical Advice

Much of the content on our site is educational or informational only. Strain descriptions, FAQs, menus, recommendation outputs, blog posts, and AI assistant responses are not a substitute for diagnosis, treatment, or advice from a qualified medical professional.

Using the site does not by itself create a doctor-patient relationship, pharmacist-patient relationship, or guarantee a prescription, consultation, sale, or delivery. Any clinical or dispensing decision remains subject to review by qualified professionals and applicable law.

Current Thailand Cannabis Controls

We operate our cannabis-related services subject to Thailand law, including the Ministry of Public Health notice on Controlled Herbs (Cannabis) B.E. 2565, published in the Royal Gazette on November 23, 2022 and effective on November 24, 2022, which classifies cannabis flower as a controlled herb under the current regulated framework.

As a result, and to the extent required by law or our compliance model:

• we may require consultation, prescription, practitioner review, or identity verification before fulfilling a cannabis-related request;
• we may refuse or cancel a request that appears unlawful, unsafe, incomplete, or non-compliant;
• online pages, menus, and forms may be limited to education, intake, reservations, appointment requests, delivery coordination, or other lawful support functions;
• certain products, promotions, or messages may be changed, withheld, or removed to comply with advertising or channel restrictions.

Accounts and Security

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activities that occur under your account. You must promptly notify us if you suspect unauthorized use.

We may suspend or terminate accounts that violate these Terms, compromise security, or create legal or compliance risk.

Prescription, Consultation, and Intake Forms

When you submit a prescription, consultation, or intake form:

• you authorize us to receive and review the information you provide;
• you confirm that the information is accurate and current;
• you understand the submission is a request only and not an acceptance, prescription, or confirmed order;
• you agree that we may contact you to verify details, request additional information, reschedule, decline, or refer the matter to a qualified professional.

If we ask for ID, passport, address, or health information, you agree to provide truthful information and any documents reasonably needed to complete lawful screening or service delivery.

Menu, Inventory, Pricing, and Availability

Product menus, educational listings, stock indications, pricing, discounts, and availability may change at any time without prior notice. Listing a product or price does not guarantee stock, reservation, or eligibility.

We may correct errors, inaccuracies, or omissions and may cancel or limit a request affected by a listing or pricing issue.

Rewards, Promotions, and Drop Campaigns

We may offer rewards memberships, points, discounts, referral-style campaigns, or location-based drop promotions. Additional rules shown in the relevant branch, app, form, or campaign page also apply.

Unless a specific promotion says otherwise:

• rewards, points, discounts, and drops have no cash value;
• they may be limited by branch, date, stock, eligibility, or legal restrictions;
• they may be modified, paused, or discontinued at any time;
• misuse, fraud, duplicate claims, or abusive behavior may result in cancellation or account suspension.

Where our rewards program rules provide for point expiry or tier conditions, those rules remain part of the applicable offer.

Delivery and Pickup

Delivery, pickup, and branch handoff options are offered only where lawful and operationally available. We may require identity checks, address verification, prescription review, or direct confirmation before completing a handoff.

Delivery windows are estimates, not guarantees. We are not responsible for delay or failure caused by legal restrictions, weather, traffic, branch volume, incomplete information, customer unavailability, or events beyond our reasonable control.

Acceptable Use

You must not:

• interfere with the operation, security, or integrity of the site or services;
• scrape, copy, reverse engineer, or reuse site content beyond what law permits;
• upload malware, attempt unauthorized access, or probe vulnerabilities;
• use automated tools to create fake accounts, claim promotions, or overwhelm the site;
• publish unlawful, defamatory, abusive, or infringing content through our services.

We may investigate suspected misuse and cooperate with authorities where required.

Intellectual Property

All trademarks, branding, site design, copy, graphics, software, databases, menus, and other content made available by us are owned by us or our licensors and are protected by applicable intellectual-property laws. Except for limited personal and lawful use of the services, no rights are granted without our prior written consent.

Third-Party Services and Links

Our services may include links to maps, messaging platforms, app stores, payment channels, medical providers, or other third-party services. We are not responsible for the content, availability, or privacy practices of third-party services that we do not control.

Disclaimers

To the fullest extent permitted by law:

• the services are provided on an "as is" and "as available" basis;
• we do not guarantee uninterrupted, error-free, or perfectly secure operation;
• we do not guarantee that a user will qualify for consultation, prescription, rewards, delivery, or any particular product;
• we are not responsible for misuse of cannabis products, failure to follow professional guidance, or use that violates law.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

Limitation of Liability

To the maximum extent permitted by law, Cannabox Co., Ltd. and its affiliates, officers, employees, agents, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the services.

Where liability cannot be excluded, it will be limited to the extent permitted by applicable law.

Suspension and Termination

We may suspend, refuse, or terminate access to all or part of the services at any time if we reasonably believe:

• you have violated these Terms;
• your use creates legal, medical, regulatory, or security risk;
• continued access is not operationally or legally appropriate.

Termination does not affect rights or obligations that by their nature should survive termination.

Governing Law

These Terms are governed by the laws of Thailand. Unless applicable law requires otherwise, disputes arising out of or relating to these Terms or the services will be subject to the courts of Thailand.

Changes to These Terms

We may revise these Terms from time to time. Updated Terms become effective when posted unless a later date is stated. Your continued use of the services after an update means you accept the revised Terms.
